Nigeria: Niger Guber Appeal - San Disowns ANPP Candidate

The appeal filed by the All Nigeria Peoples Party (ANPP) governorship candidate in Niger State, David Umaru before the Court of Appeal in Abuja against the judgement of the state governorship Election Petitions Tribunal which upheld the election of Governor Babangida Aliyu, has suffered a major setback following a blunt declaration by a senior advocate of Nigeria, Alhaji Abdullahi Ibrahim, that he is not part of the appellant's legal team.
Ibrahim's position was communicated to the appellate court through a letter from Rickey Tarfa's Chambers, which informed the court that there was an erroneous insertion of the senior advocate's name as lead counsel for Umaru.
The letter dated September 8, 2008 and addressed to the registrar of the court stated, "Please, be informed that the insertion of Alhaji Abdullahi Ibrahim (CON, SAN) as lead counsel for the appellants in the appellants brief filed on 31st July, 2008 was done in error.
"The learned senior advocate is not a counsel in this appeal and is not to be regarded as such, neither is anyone from the law firm of Abdullahi Ibrahim and Co. The error is regretted."
Sources close to LEADERSHIP WEEKEND from the state, hinted that Umaru's choice of Ibrahim as his lead counsel may not only have been informed by the fact that he is a brilliant member of the inner bar, but that he is very influential in matters involving the leadership of the state.
"Don't forget that Ibrahim was a former attorney-general during the regime of General Ibrahim Babangida as military president and still possesses the clout to make a difference politically," one of our sources noted.
The governorship election tribunal in Minna, the capital of Niger State, had on June 9, 2008, affirmed the election of Governor Aliyu in the April 2007 polls and declared that the governor was not only qualified to contest, but secured the highest number of lawful votes.
Dissatisfied with the pronouncement, Umaru approached the Court of Appeal in Abuja where he lodged an appeal in which he contended that the tribunal justices misdirected themselves in reaching such a decision; hence there was a miscarriage of justice.
